yes unfortunatly due to someone wasting my time for over seven weeks with buying it, and then he pulled out after paying me a large depsit im having to relist the van again now.[V][!]
i honestly cant understand whats going on with some people.try and work this one out in your heads then. the guy who bought this van from me, origonaly bought a dark green suntour major van first, which was listed on ebay and was being sold by another forum member a few months back. anyway he bought the van from this other member, and then called me up and asked if he could drop the van off here, so that i could have a good look at it, and give him a price on restoring the van for him,as his father had recently passed away and he wanted to own a commer because his dad had owned one many years ago, and he wanted to get another one so that him and his brother could go touring together to re live old memories. anyway after the van being here for a few weeks over christmas i gave him a price to restore everything on the van ,which is what he had asked for, only to be then told he couldnt afford to have it done. he then asked if i had any other vans for sale?. i told him about mine and sent some pictures via email, he was delighted with the pics and paid a deposit over there and then without any hesitation ,and saying he definately wanted the van etc. two weeks later he came down to view the van and paid a bit more towards the final cost of the van van but asked if i could sort out a slight misfire on the van before he attempted to drive it away and pay the balance.i agreed to this and he said he would be back in a weeks time to collect it. i had the work done on the van and awaited his return to collect it only to be let down with a no show. strange i thought so i called him up but i got no response. i tried again later but still nothing. then a week or so went passed and i got a message vis text from him saying he was going to collect the following week. guess what happened next?. yes thats right no show again. i then text him again only for his son to text me back saying that dad wasnt well with the sickness bug, but one of his work pals was going to come and view the van sometime that coming week. anyway the guy eventually turned up without any notice and then started to try and find faults with the van that went even there , and that the other buyer had not even mentioned about on his previous visit. i told the guy to do one basicly, and said that as far as i was concerned a deal was already done between me and the buyer. he told me that he would report back anyway to his boss and that they would be in touch. another week or so passed and then the big bomb shell got dropped on me visa text message again, saying that he had changed his mind and that he would arrange for the collection of his own van, and that could i re pay him back the deposit that he had given to me for the van. a total of over seven weeks had gone by and been wasted , and i had also lost another potential buyer who had shown interest in buying the van at around the same time, buy because this other guy had paid a deposit i stuck to the deal thinking it was the right thing to do. anyway that was two months ago and still the guys van is sitting here at my workshop and i have not heard from or seen the guy since. so now i dont know what to do, other than relist my own van. it just beggars belief really what some people are thinking about.[?][V][!]
i hate messers. that van is a proper tool. look at it this way mate, that van is fantastic to look at and sign written for your company. it needs to go to a loving home that will take care of it and use it regularly (thus advertising you and boosting your buisiness). not someone that is gonna mess you around about getting it. then get bored in no time and lock it away again. i know it wont help the fact that you have been messed about but it may make you feel a little better

did not think you had to return a deposit if the seller pulls out and the goods are of the same description on collection to when the deposit was paid[?] also you are intitled to persue the balance as they have entered a legal agreement
do what the car clampers do,charge storage on a daily basis, its not your problem and noway should you be inconvenienced and certainly not out of pocket.certainly dont give the deposit back as you could use it against a storage fee
Deposits do not have to be refunded.
Once a deposit has been paid a legally binding contract is formed. If the buyer decides not to go ahead with the purchase the seller can sue for the balance owing or for other expenses such as readvertising etc.
If the van is not removed from your premises you should write to the owner giving him 30 days to collect the vehicle and advise him that if it is not removed it will be sold, if he does not collect the van or respond it becomes yours to sell. Legal!
